LuxaPass

Terms of service

Last updated: 27 October 2026

These terms govern your use of the LuxaPass website and, once launched, the LuxaPass app and membership. By using the website you agree to these terms. The membership terms below are indicative and will be finalised before launch.

1.About LuxaPass

LuxaPass is a membership service operated by The Elephant B.V., registered in the Netherlands (KvK: 97165409), that lets members discover and book classes, gym visits and wellness sessions at independent partner venues across Luxembourg using monthly credits. LuxaPass is not the provider of the classes themselves; each venue remains responsible for its own facilities, instructors and safety.

2.Website

The website is provided for information about our upcoming service. Nothing on it constitutes an offer to subscribe, and the plans and prices shown are indicative until launch.

3.Eligibility

You must be at least 18 years old and able to enter into a binding contract to create an account or purchase a membership.

4.Membership and credits

Memberships are billed monthly in euros and renew automatically until cancelled. Each plan includes a set number of credits per cycle. Credits are deducted when you book; the credit cost of each session is shown before you confirm. Unused credits roll over to the following cycle up to the limit of your plan while your membership is active. Credits have no cash value and cannot be transferred.

5.Bookings, cancellations and no-shows

You can cancel a booking free of charge until the venue's cancellation window closes, which is shown at the time of booking. Late cancellations and missed bookings may result in the loss of the credits used and a fee that will always be displayed before you book.

6.Changing or cancelling your membership

You can upgrade, downgrade or cancel your membership at any time in the app. Changes and cancellations take effect at the end of the current billing cycle. Statutory withdrawal rights for distance contracts under Luxembourg consumer law are not affected.

7.Conduct at partner venues

Members must follow the house rules of each venue and treat staff, instructors and other members with respect. Venues may refuse entry to anyone who breaches their rules, and repeated breaches may lead to suspension of your membership.

8.Health and safety

Physical activity carries inherent risks. You are responsible for making sure you are fit to participate and for seeking medical advice where appropriate. To the extent permitted by law, LuxaPass is not liable for injuries sustained at partner venues.

9.Intellectual property

The LuxaPass name, logo, website and app are protected by intellectual property rights and may not be copied or reused without our written permission.

10.Liability

Nothing in these terms excludes liability that cannot be excluded under Luxembourg law. Otherwise, our liability for any claim is limited to the membership fees you paid in the three months before the event giving rise to the claim.

11.Governing law

These terms are governed by the laws of the Grand Duchy of Luxembourg. Disputes will be submitted to the competent courts of Luxembourg City, without prejudice to your rights as a consumer. Consumers may also use the EU online dispute resolution platform at ec.europa.eu/consumers/odr.
